二、租赁用途

2-1乙方向甲方承诺，租赁该房屋作为使用，并遵守国家和本市有关房屋使用和物业管理的规定。

三、交付日期和租赁期限

3-2租赁期满，甲方有权收回该房屋，乙方应如期返还。乙方需继续承租房屋的，则应于租赁期届满前 贰个月，向甲方提出续租书面要求，经甲方同意后重新签订租赁合同。

五、保证金和其他费用

5-1甲、乙双方约定，甲方交付该房屋时，乙方应向甲方支付房屋租赁保证金，保证金为贰个月的租金，即（ RMB ）。甲方收取保证金后应向乙方开具收款凭证。 租赁关系终止时，甲方收取的房屋租赁保证金除用以抵充合同约定由乙方承担的费用外，剩余部分无息归还乙方。

六、房屋使用要求和维修责任

6-1租赁期间，乙方发现该房屋及其附属设施有损坏或故障时，应及时通知甲方修复；甲方应在接到乙方通知后的 叁日内进行维修。逾期不维修的，乙方可代为维修，费用由甲方承担。

三、房屋修缮与使用

1、在租赁期内，甲方应保证出租房屋的使用安全。乙方应合理使用其所承租的房屋及其附属设施。如乙方因使用不当造成房屋及设施损坏的，乙方应负责修复或给予经济赔偿。

2、该房屋及所属设施的维修责任除双方在本合同及补充条款中约定外，均由甲方负责（但乙方使用不当除外）。甲方进行维修须提前七天通知乙方，乙方应积极协助配合。

3、乙方因使用需要，在不影响房屋结构的前提下，可以对房屋进行装修装饰，但其设计规模、范围、工艺、用料等方案应事先征得甲方的同意后方可施工。租赁期满后，依附于房屋的装修归甲方所有。对乙方的装修装饰部分甲方不负有修缮的义务。

四、合同的终止：乙方有下列情形之一的，甲方可以终止合同，收回房屋。

1、租赁期间，未经甲方书面同意，乙方擅自转租、转借承租房屋。

2、乙方拖欠房租达10天以上，并不说明原因的。

3、乙方利用承租房屋进行非法活动，损害公共利益，打扰邻居正常生活的。

五、违约处理

1、合同期内，在甲方没有违约的情况下，乙方如果终止合同，应向甲方支付违约金_________元。

甲、乙双方就房屋租赁事宜，达成如下协议：

一、甲方将自有的坐落在__ __（简称本房产），出租给乙方作____ ____使用。双方约定本房产的租赁期为_ _年_月__ 日起到_年 月_ _日。共计___个月。

3、屋内用具不得损坏、丢失，否则，照价赔偿。

4. 现金等贵重物品乙方必须妥善保管，如有丢失，责任自负。

五、甲方在合同期内，不能擅自无故收回租给乙方的房屋，如有类似行为而造成乙方的经济损失时应赔偿乙方相应损失费用。

六、乙方对租用房没有处理权，不能擅自与人合租、转租或借给他人，也不能改变其用途，否则属于违约。如有此类情况发生，甲方有权解除协议并收回房屋。

七、租赁期满后，如乙方要求继续租赁，则须提前__1 _个月向甲方提出，甲方收到乙方要求后__3__天内答复。如同意继续租赁，则续签租赁合同。同等条件下，乙方享有优先租赁的权利。在原租期已到期，新的续租协议还未签订的情况下，甲方有权收回房屋，不再签约续租。

八、乙方租期未到期而要求退租时，必须与甲方协商一致。乙方承租到期应完好归还房屋和所有钥匙及有关物品，如果所租房内的所用设备有损坏，乙方负责修复或者赔偿相应金额。

九、合同的解除

租赁期间，乙方有下列情形之一的，甲方有权终止合同，收回本房产。

（1）擅自将房屋转让，对外投资入股或与他人调换；

（2）利用承租房屋进行非法活动，损害社会公共利益的；

（3）乙方未按约定期限支付租金超过一个月。

若甲方依上述第1、2、3项约定而解除合同，并有权追述乙方法律责任。

十一、发生争议时，甲、乙双方友好协商解决。如协商不成，提请由当地人民法院仲裁。 十二、本合同一式两份，甲、乙双方各执一份，自双方签字之日起生效。
