一、出租房屋情况

1-2甲方作为该房屋的 房地产权利人 (房地产权利人/代管人/法律规定的其他权利人)与乙方建立租赁关系。签订本合同前，甲方已告知乙方该房屋 未(/未)设定抵押。

1-3该房屋的公用或合用部位的使用范围、条件和要求；现有装修、附属设施、设备状况和甲方同意乙方自行装修和增设附属设施的内容、标准及需约定的有关事宜，由甲、乙双方分别在本合同附件(二)、(三)中加以列明。甲、乙双方同意该附件作为甲方向乙方交付该房屋和本合同终止时乙方向甲方返还该房屋的验收依据。

二、租赁用途

2-1乙方向甲方承诺，租赁该房屋作为使用，并遵守国家和本市有关房屋使用和物业管理的规定。

2-2乙方保证，在租赁期内未征得甲方书面同意以及按规定须经有关部门审批核准前，不擅自改变上款约定的使用用途。

三、交付日期和租赁期限

3-1甲乙双方约定，甲方于年日前向乙方交付该房屋。【出租】房屋租赁期

3-2租赁期满，甲方有权收回该房屋，乙方应如期返还。乙方需继续承租房屋的，则应于租赁期届满前 贰个月，向甲方提出续租书面要求，经甲方同意后重新签订租赁合同。

四、租金、支付方式和期限

五、保证金和其他费用

5-1甲、乙双方约定，甲方交付该房屋时，乙方应向甲方支付房屋租赁保证金，保证金为贰个月的租金，即（ RMB ）。甲方收取保证金后应向乙方开具收款凭证。 租赁关系终止时，甲方收取的房屋租赁保证金除用以抵充合同约定由乙方承担的费用外，剩余部分无息归还乙方。

六、房屋使用要求和维修责任

6-1租赁期间，乙方发现该房屋及其附属设施有损坏或故障时，应及时通知甲方修复；甲方应在接到乙方通知后的 叁日内进行维修。逾期不维修的，乙方可代为维修，费用由甲方承担。

房 屋 租 赁 合 同

出租方：合肥八方房地产开发有限公司 （以下简称甲方） 承租方：合肥花园城物业管理有限责任公司（以下简称乙方）

乙方拟租赁甲方位于新加坡花园城文华阁 0148 号房屋作物业办公

用房，现经甲乙双方协商，一致同意签订合同条款如下：

第一条：房屋座落、建筑面积

甲方租赁给乙方的房屋座落于长江西路898号“新加坡花园城”文华

阁 0148 号房，建筑面积共294.95 ㎡。

第二条：租期、租金与押金：

（一）租期：自2011年 元 月1 日至2012 年 6 月 30 日止。

（二）租金：合计3000元。

（三）租房押金：为确保合同的顺利执行，乙方必须支付给甲方租

房押金10000 元。如遇乙方违约等情况，其违约金甲方可直接从押金中

扣除。

第三条：押金交付期限及办法：

乙方必须将房租费3000元及押金 10000 元在本合同生效之日起三

天内一次性支付给甲方。付款方式以现金支付（或转帐支付）。

第四条：双方责任：

（一）甲方责任：

1、负责修缮所出租的房屋及其由甲方提供的基础设施，以保障乙

方的安全和正常使用，但属于乙方使用不当造成的损坏，由乙方自行修

理。

2、甲方如出售房屋，须提前二个月通知乙方，在同等条件下，乙

方有优先购买权。

3、合同期满，在同等条件下，乙方有优先续租权。

4、负责按约定，依时交付房屋给乙方使用。

5、合同期满，如乙方不再续租，且乙方无违约现象，甲方必须按时退回押金给乙方（不计息）。

（二）乙方责任：

1、合同期满，如不续租，必须按时交回房屋给甲方，不得拖延，否则甲方有权加收相应的租金。

2、承租期内，不得单方面转租他人，否则，按违约论处，甲方有权终止合同，并没收全部押金。

3、承租期内，如乙方单方面终止合同，即按违约论处，甲方有权收回房屋，并没收乙方的全部押金。

4、承租期内，乙方不得随意破坏、变更甲方的房屋结构及其公共设施、设备。否则，按违约论处。由此造成房屋、设施、设备的损毁，乙方必须负责修复或赔偿，所需费用全部由乙方承担。甲方有权终止合同，没收全部押金。

5、水电、排污、排烟问题。外水电由甲方提供给乙方使用，但水电的增容乙方必须自行解决。其增容费用和日常水电费用由乙方自理。排污系统由乙方排入市政管网；排烟必须达到环保要求并按环保部门的要求安装排烟系统，费用由乙方自理。

6、乙方承租期间，政府及社会公共职能部门收取的各种费用由乙方自理。

7、乙方不得制造各种污染，不得利用该房屋从事有毒有害、危险品及各种违法乱纪活动经营，否则，甲方有权终止合同并没收至少50%的押金。

第五条：违约责任：

本合同是经双方协商一致同意签订的，双方均应严格遵守合同各项条款，如有违约，违约方必须给守约方支付违约金元20000元整。从违约之日起，超过一个月仍不能整改完毕的，守约方有权解除合同。（本

第六条：免责条件：

1、租赁期内，房屋因不可抗力的原因造成损坏的，双方免责。

2、因政策、法律法规原因、市政建设或花园城的旧楼拆迁的，双方免责。

第七条：争议的解决：

甲乙双方在租赁期内，如发生争议，则由双方协商解决，如协商不成，可由当地仲裁委仲裁或向人民法院提起诉讼。

第八条：本合同壹式贰份，甲乙双方各执壹份，合同自双方签字（盖章）之日起生效，期满或双方责任履行完后失效。

篇三：房屋租赁合同

甲、乙双方就房屋租赁事宜，达成如下协议：

一、甲方将位于新加坡自建房第二栋楼第二层全部与一楼的一套房屋出租给乙方开班办幼儿园，（楼顶免费给乙方使用，五年内不增建楼层）。租赁期限自2014年7月6日至2019年7月6日止，共计租期伍年。

二、出租房屋（第二栋楼第二层全部与一楼的一套房屋）月租金：叁仟伍百（￥3500.00）元整。五年内不得增涨房租。房租第一年按按半年交一次。（2014年7月6日与2015年3(转 载于:www.zaIdian.cOM 在 点 网)月6日）第二年至第五年，是一年一次交清。（2014年9月6日）

三、押金叁万（30000.00）元。第一年（2014年7月6日）先交贰万（20000.00）元，第二年（2015年9月6日）交壹万（10000.00）元。

四、甲方将房屋所有设施完好交给乙方，乙方使用期内有损坏的须自己维修。

五、乙方租赁期间，发生其它自然因素或国家行为变故，须终止合同，押金，租金恕不退还，水费、电费、以及其它由乙方使用而产生的费用由乙方负担交清。

六、乙方征得甲方同意，装修时改造房屋的隔墙（非承重墙），保留厕所，并承担装修改造费用。租赁结束时，乙方须将房屋设施恢复原状。

七、乙方所建幼儿园防护安全措施必须符合国家相关要求，必须遵守国家法律，法规，不得在出租屋内做任何违法之事（以国家机关判决书为准），否则甲方有权收回房屋，押金、租金恕不退还。乙方

在签订合同之日到合同终止之日，幼儿园发生的一切安全事故与甲方无关。

八、如乙方在租赁办幼儿园过程中，中途转让幼儿园，甲方不能以任何借口阻挠干涉，但甲方将收取百分之八（8%）的转让费。届时，甲方将押金叁万（30000.00）元全额退还乙方。由承接方负责将房屋设施恢复原状。

九、幼儿园噪音如严重影响邻居正常生活，邻居集体反映，甲方须帮忙进行调解，如调解不成，造成国家行政机关强制要求搬走，则甲方不赔偿乙方任何损失。

十、租赁期满后，如乙方要求继续租赁，则须提前 1个月向甲方提出，甲方收到乙方要求后7天内答复。如同意继续租赁，则续签租赁合同。同等条件下，乙方享有优先租赁的权利。

十一、发生争议，甲、乙双方友好协商解决。协商不成时，提请由当地人民法院仲裁。在此期间，甲方不能干扰乙方幼儿园正常教学秩序。

十二、以上甲乙双方自愿自主协议，如一方违反，则赔偿对方违约金 陆万（￥60000.00）元。
